. Introductory provision
These general terms and conditions apply to the sale of joymakers by Daisy Van Wouwe via her webshop “Griffel-Gifts”. Placing an order on the webshop leads to the acceptance of these general terms and conditions. Griffel-Gifts reserves the right to change and/or supplement these general terms and conditions at any time for future orders. The conditions that were applicable at the time the agreement was concluded apply to current agreements.
. Definitions
In these general terms and conditions, the following terms are understood to mean:
“Griffel-Gifts”: the webshop of the sole proprietorship Daisy Van Wouwe on which the joymakers are offered and sold to customers.
“Customer”: any natural person or legal entity who places an order via the webshop “Griffel-Gifts”.
“Order”: the request by the customer to conclude a sales agreement between Daisy Van Wouwe and the customer of the internet shop “Griffel-Gifts” with regard to the happy makers that are offered there.
“Joymakers”: all goods offered by Daisy Van Wouwe via Griffel-Gifts that can form the subject of one or more agreements.

. Offers and conclusion of agreements
Offers are valid while stocks last. An agreement is concluded at the moment that an e-mail is sent to the e-mail address provided by the customer to confirm his order. The customer and Griffel-Gifts expressly agree that a valid agreement can be concluded by using electronic forms of communication. In particular, the absence of a regular signature does not affect the binding force of the agreement. To the extent permitted by law, the electronic files of Griffel-Gifts are considered a presumption of evidence for this. Griffel-Gifts reserves the right to refuse orders in the following cases:
• if a happy maker is not in stock
• if there is a serious suspicion of abuse of rights or bad faith on the part of the customer
• in the event of force majeure.
. Prices
All prices are expressed in euros and include VAT. The price stated in the e-mail confirming an order is the price owed by the customer. Special offers are only valid while stocks last and/or the stated end date of the offer. Griffel-Gifts reserves the right to change the price of a joymaker at any time, but joymakers are always invoiced based on the applicable rates at the time the agreement is concluded .
. Payment
As an expert in custom happy makers, we naturally also want to give you as a customer a happy feeling during check-out, which is why our payments are processed via Mollie. This way, you as a customer can make the payment with a safe feeling. Your order will be processed as soon as we have received confirmation of payment via Mollie.
For payments by bank transfer from outside Belgium, it is mandatory to use the IBAN and BIC code when making the payment.

In the event of late payment by the customer or problems with payments for previous orders, Griffel-Gifts is entitled to terminate an agreement.
. Delivery and delivery time
Griffel-Gifts strives to process orders placed as soon as possible. Since the processing procedure is more complicated for some joymakers than for others, we cannot specify a specific processing time. We will of course do everything we can to process your order as soon as possible.
The stated delivery times are always indicative and therefore no rights can be derived from them. If a joymaker is not in stock, the customer will be informed by e-mail about a later delivery date. If the customer does not agree with the delay, the order can be cancelled or the customer can order an alternative. The cancelled joymaker will be refunded. When ordering an alternative, the overpaid/underpaid amount will be refunded/invoiced additionally.
If, in case of problems with the delivery company, the delivery date is exceeded by 15 working days, the customer is obliged to inform us of this by e-mail. In that case, the customer can cancel his order and we will instruct Mollie to make a refund within 10 working days after receiving the information.
If, in case of delivery problems with the supplier, the delivery date is exceeded by 15 working days, Griffel-Gifts will inform the customer by e-mail. In that case, the customer can cancel his order and we will instruct Mollie to make a refund within 10 working days. Deliveries take place at the address specified by the customer when ordering. Griffel-Gifts cannot be held responsible in any way for errors made by the customer when entering the delivery and/or billing address and which may lead to delays in delivery or the impossibility of delivering the ordered happy makers.
As soon as the products to be delivered have been delivered to the specified delivery address, the risk for the delivered happy makers is transferred to the customer.
. Photos
Although we strive to only place high-quality photos with our joymakers, there may be a color deviation on the model shown and the goods sent to you. Under no circumstances can this possible color difference give rise to a complaint. Additional items on photos for decoration are not included.
. Personalized goods
Orders via Griffel-Gifts for personalizing the joymakers offered on the webshop with your own photo or name, will only be put into production after full payment has been made. Griffel-Gifts is not responsible for copyright prosecutions regarding photos provided by the customer. For each photo that is forwarded, the customer must have the rights of use, without Griffel-Gifts being expected to check this. If the name of the copyright owner has been removed, whether or not intentionally, this is entirely the responsibility of the customer. Griffel-Gifts can under no circumstances be held liable for photos wrongly provided by the customer and will therefore refer all claims resulting from this to the customer.
The production process starts as soon as payment has been completed. As soon as the joymakers are finished, they will be shipped. Cancellation of this order is under no circumstances possible once the production process has started.
The customer cannot under any circumstances cancel the purchase of personalized joymakers.

Shipments to countries not mentioned in the shipping list are discussed for the processing of the order by Griffel-Gifts.
. Exchange
A customer can exchange a joymaker within 14 working days from the day following the delivery of an order. In this case, we ask you to notify us immediately after delivery by e-mail and to return the joymakers within 14 calendar days from the day following delivery. We ask you to indicate in the e-mail for which joymaker you wish to exchange your purchase. Exchange is only possible if the joymaker has not been used and the packaging is undamaged and is sent along. If you wish to exchange the joymaker for a joymaker of a different value, the balance will be refunded/invoiced extra, depending on the case. The shipping costs, the risk of returning the joymaker for exchange are borne by the customer, as well as the shipping costs of the item to be sent again. . Cancellation A customer can cancel the purchase of a joymaker within 14 days from the day following the delivery of an order, without giving a reason or without paying a fine. In this case, we ask you to notify us immediately after delivery by e-mail and to return the joymakers within 14 calendar days from the day following the delivery. This is only possible if the joymaker has not been used and the packaging is intact and is sent along. The shipping costs and the risk of returning a joymaker are borne by the customer. In the event of cancellation, Griffel-Gifts will refund the purchase price to the customer within 14 calendar days after receipt of the returned products. . Warranty on manufacturing defects If after delivery it appears that a joymaker has manufacturing defects, we ask you to return it and we will send you a new joymaker (the same product or an alternative determined in consultation) as a replacement without shipping costs. We will refund you the shipping costs for the returned product within 10 working days. We ask you to report this irregularity immediately upon receipt.
. Privacy
We keep a number of personal data for communication with our customers and the smooth processing of orders. We undertake never to pass on the data of our customers to third parties. You can view, change or have your personal data deleted in whole or in part at any time. This can be done by sending an e-mail to info@griffel-gifts.com with your request for change or deletion.
. Copyright
Copyright applies to all photos and images shown on the Griffel-Gifts website. This applies to all images, regardless of the method of distribution or the form in which they are delivered. No photo may be reproduced and/or made public by means of printing, photocopying, photo of photo, microfilm, digitally or in any other way without prior written permission from Daisy Van Wouwe. If you use a photo from this website without prior permission, you will be urged to stop using it and a claim for damages will be filed with you.
. Applicable law
If difficulties arise during the execution of an agreement, the customer and Griffel-Gifts undertake to investigate the possibility of reaching an amicable settlement before taking legal action. If this does not provide a solution, only the courts of Turnhout are competent to hear any claims, regardless of the place of delivery or the customer's place of residence. The agreements and all legal reports between the customer and Griffel-Gifts are subject to Belgian law.
